Terms of Service

These terms are the agreement between you and CardWise for the CardWise app, the website at cardwise.pt, and the services behind them (together, "CardWise"). By creating an account, booking a slot through a booking page, or otherwise using CardWise, you accept them. Our Privacy Policy explains how we handle personal data and forms part of these terms.
1. Who can use CardWise
- You must be at least 16 years old.
- You must give accurate information when you register and keep it up to date. One person, one account.
- An account created without a verified mobile number has 7 days to add one. After that it is deactivated until a number is verified. This keeps accounts recoverable and reduces fraudulent sign-ups.
- You are responsible for keeping your credentials private and for everything done through your account. Turn on two-factor authentication if you can.
2. What CardWise provides
A place to store and organise contacts (including by scanning paper cards), a digital card you can share, chat and calls with other users, public booking pages, calendar sync, imports from other tools, a card-design editor and marketplace, and a Caller ID feature. Features may differ between Android and iOS and may change over time. Where a feature is described as free, it is free; we will tell you before any feature starts costing money.
3. Your content
- You own what you put into CardWise: contacts, scans, photos, messages, designs, notes. You give us a licence to store, process, transmit and display that content only as needed to run the features you use — for example to sync it across your devices, deliver a message to its recipient, show your card to someone you shared it with, or name you to another user via Caller ID.
- You are responsible for having the right to store and share the content you add, including other people's details. Only share a person's card or contact details with someone else if you are entitled to.
- Files you upload (photos, card images, chat attachments) are stored at unguessable public URLs. Anyone who has the URL can open the file. Do not upload anything you would not be comfortable being reachable that way.
- We may remove content that breaks these terms or the law, and will tell you when we do unless the law prevents it.
4. Acceptable use
You agree not to:
- harass, threaten, impersonate or defraud anyone, or collect information about people without a lawful basis;
- use chat, calls, share links or booking pages for unsolicited bulk messaging or advertising;
- contribute a name to the Caller ID directory or report a number as spam that you know to be false, or use the opt-out page for a number that is not yours;
- upload malware, or content that is unlawful, infringing, abusive or sexually explicit;
- scrape, probe, reverse-engineer, overload or interfere with CardWise or its servers, or bypass a limit or a block;
- use another person's account, or let someone else use yours;
- use CardWise where doing so is illegal.
5. Sharing your card and connecting with others
- A share link or QR code lets anyone who has it open your card for 30 days and, if they use CardWise, save it. Share links accordingly.
- When you add a contact, CardWise may tell you whether that person has an account so you can connect; people who have turned off Profile Visibility are never matched. You may be notified when someone saves your details, and you can switch that off.
- You can block a user at any time. Blocked users cannot message or call you.
6. Caller ID
- Caller ID shows names for incoming numbers, drawn from callers' own accounts and from contacts that users have added to CardWise. It is informational only: it never blocks, silences or answers a call. Treat a shown name or spam label as a hint, not a guarantee.
- By adding contacts while the Caller ID switch is on, you contribute their names and numbers to the shared directory under the terms in the Privacy Policy. You can switch this off and withdraw your contributions at any time.
- Anyone may remove their own number at cardwise.pt/directory/opt-out. Removal is permanent.
- Availability of Caller ID depends on your country and platform; we may withdraw it in a market where it cannot lawfully operate.
7. Bookings
- If you publish a booking page you are responsible for the accuracy of your availability and for honouring, or cancelling with reasonable notice, slots that guests book. CardWise sends confirmation emails on your behalf but is not a party to the meeting and does not handle payment for it.
- If you book with someone, you agree to attend or let them know. The host sees the name, email and note you enter.
8. Connected services and imports
Connecting Google or Microsoft Calendar, or importing from HubSpot, Pipedrive, Google Sheets or your phone, is optional and governed by that service's own terms as well as these. You are responsible for having the right to import the data you import. You can disconnect at any time.
9. Card designs and the marketplace
- You keep the rights to designs you create. If you publish a design to the marketplace you grant CardWise the right to display it, and buyers the right to use it on their own cards. You must own or have licence to every font, image and element in a published design.
- Paid designs are not yet on sale. When they are, prices, payment methods, refunds and any revenue share will be set out in the app before you buy or sell, and those terms will apply in addition to these.
- We may remove a marketplace design that infringes someone's rights or breaks these terms.
10. Privacy and security
We handle personal data as described in the Privacy Policy. Tell us at once if you think your account has been accessed without permission. We may sign out sessions, require re-verification or suspend an account to protect you or other users.
11. Our rights in CardWise
CardWise, its software, design, name and logo belong to us or our licensors. These terms give you a personal, non-transferable licence to use the app for its intended purpose and nothing more. You may not copy, modify, distribute or create derivative works from CardWise except as the law allows.
12. Availability and changes
We work to keep CardWise available and your data intact, but the service is provided "as is" and "as available". We may add, change or withdraw features, and we may update these terms. For material changes we will notify you in the app or by email before they take effect; using CardWise after that means you accept the change. If you don't, stop using CardWise and delete your account.
13. Ending the agreement
- You can stop using CardWise at any time and ask us to delete your account — see Account & Data Deletion.
- We may suspend or close an account that breaks these terms, creates risk for other users, or is required to be closed by law. Where reasonable we'll warn you first and give you a chance to export your data.
- Sections 3 (licence for content already shared), 11, 14, 15 and 16 survive termination.
14. Disclaimers
To the extent the law allows, we make no promises that CardWise will be uninterrupted, error-free, or that scanned text, Caller ID names, spam labels or calendar sync will be accurate. You are responsible for checking important details. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
15. Liability
To the extent the law allows, CardWise is not liable for indirect, incidental or consequential loss, loss of business, profits or data, arising from your use of or inability to use CardWise. Our total liability for any claim is limited to the greater of €50 and the amount you paid us in the 12 months before the claim. Nothing excludes liability for fraud, wilful misconduct, gross negligence, death or personal injury, or anything that cannot be excluded by law.
16. Governing law and disputes
These terms are governed by the laws of Portugal. Disputes go to the courts of Lisbon, Portugal, except that consumers in the EU/EEA may bring or defend a claim in the courts of their own country of residence and keep the protection of that country's mandatory consumer law. EU consumers may also use the European Commission's online dispute resolution platform. We'd rather talk first: email us and we will try to sort it out.
17. General
- If part of these terms is found unenforceable, the rest still applies.
- Not enforcing a term straight away does not waive it.
- You may not transfer your account or this agreement to anyone else. We may transfer it to a successor of the CardWise business, with notice to you.
- These terms, the Privacy Policy and any feature-specific terms shown in the app are the whole agreement between us about CardWise.
